Generally, a “disqualified person” includes, but is not limited to:
- Yourself
- Your spouse
- Your lineal ascendants and descendants
- The spouse of a lineal descendant
- Any entity that is owned 50% or more by disqualified persons
- An entity that is controlled 50% or more by disqualified persons
In the self-directed world, your IRA account is buying the property and not you as an individual. Therefore, assets should be titled as follows:
“Custodian FBO: (Account holder name and Account Type)”
All documents related to the purchase of an asset, such as the contract/purchase agreement, title commitment/insurance, liability insurance, etc. must be titled accordingly.
